The following terms and conditions (the “Terms and Conditions”) govern the Pita Pit More! gift card and loyalty programs offered by Pita Pit Limited (herein, “we”, “us”, “our”). By using your Pita Pit More! Card, key fob or mobile app, you agree to these Terms and Conditions, as amended from time to time.

Pita Pit More! Gift Card

Pita Pit More! gift cards and key fobs may be purchased at any participating Pita Pit location. If you download the Pita Pit More! mobile app (the “App”), you may follow the prompts to be able to use your mobile device in addition to, or instead of, your physical card or key fob. For the purposes of these Terms and Conditions, “gift card” refers to the physical Pita Pit More! gift card, App, key fob or any other device issued by associated with the Pita Pit More! gift card program.

Gift cards are redeemable for merchandise only at participating Pita Pit locations in Canada and are not redeemable for cash unless otherwise required by law. Gift cards may not be applied to previously purchased merchandise or used toward payment of a credit account. All sales are final.

Gift cards may be reloaded at any participating Pita Pit location, at PitaPit.ca/More (the “Program Site”), or using the App. You may set up an auto-reload of funds to your gift card through the Program Site or the App by setting up an account (“Account”) and providing certain information, including credit card and related payment and billing information. We may request further information to validate the transaction. By providing such information, you warrant that all information provided is current and accurate. To create an Account, you must be a legal resident of Canada (excluding Quebec) and over the age of majority in the province or territory in which you reside. We reserve the right to terminate your Account if we determine, in our sole discretion, that you have violated these Terms and Conditions, or that the use of your account is unauthorized, fraudulent or otherwise unlawful. You are responsible for any and all activities that occur under your Account. Keep your password secure. You agree to (a) immediately notify us of any unauthorized use of your password or Account or any other breach of security, and (b) ensure that you exit from your Account at the end of each session when accessing the Program Site or the App. We will not be liable for any loss or damage arising from your failure to protect the security of your Account. We may communicate with you about your Account by email, SMS and/or push notification. See our Privacy Policy for more information about how we collect, use and manage your personal information.

You can check your gift card account balance on the Program Site, in the App, or by inquiring at a participating Pita Pit location.

You may not return or cancel any gift card or reload after it is purchased. Physical gift cards are not replaceable if lost, stolen or damaged. We are not responsible for lost or stolen gift cards or the remaining balances on such gift cards. If you have registered your gift card by creating an account on the Program Site or the App, you can deactivate and re-issue a lost or stolen gift card through the Program Site or the App. Your gift card account balance is yours and may not be transferred or assigned to anyone else or another gift card account.

Your gift card may also be used as a loyalty program card to participate in the Pita Pit More! loyalty program (the “Loyalty Program”). To participate in the Loyalty Program you must register your gift card on the Program Site or the App. Use of your gift card as a Loyalty Program card is subject to the Loyalty Rewards Program terms and conditions provided below.

Loyalty Program

To participate in the Loyalty Program, you must be a resident of Canada (excluding Quebec) over the age of majority in the province or territory in which you live, and register a Pita Pit More! loyalty account.

By participating in the Loyalty Program, you unconditionally agree to these Terms and Conditions. If you do not agree to these Terms and Conditions, or any future amendment to these Terms and Conditions, do not participate (or stop participating) in the Loyalty Program. In addition, you are subject to our Privacy Policy, which is incorporated herein by reference.

We reserve the right to modify or change these Terms and Conditions, or to terminate the Loyalty Program, at any time without prior notice. We shall post the most current version of the Terms and Conditions on the Program Site and App, and may advise you of material changes by posting a notice on the Program Site and App, by notice in participating Pita Pit locations, or by email, in our sole discretion.

Registration

To register for our Loyalty Program, first create an Account (see above) on the Program Site or with the App and then link your gift card number (printed on our physical card or key fob) to your Account. You will be requested to provide required and optional information, as prompted, and may have the opportunity to request to receive additional marketing communications from us. You may opt out of these marketing emails at any time without impacting our ability to contact you by email, SMS or push notification about your Account and the Loyalty Program. To redeem loyalty points for rewards you must first create an Account.

Earning Points

Earn points by making purchases at participating Pita Pit locations using your gift card, and more. The Loyalty Program has two tier levels (the Fan Level and the Fanatic Level) at which points may be earned. By registering your Account, you will be automatically enrolled in the Loyalty Program at the Fan Level. Earn a total of at least two thousand (2000) reward points within the twelve (12) month period following your enrollment date, and you will proceed to the Fanatic Level for the next period of twelve (12) consecutive months. On each anniversary date of your enrollment date (the “Anniversary Date”) you will be advanced to the Fanatic Level if you have earned a total of at least two thousand (2000) reward points within the twelve (12) month period immediately prior to the Anniversary Date. You will be moved to the Fan Level on the Anniversary Date if you have not earned at least two thousand (2000) reward points within the twelve (12) month period immediately prior to the Anniversary Date.

Points have no cash value and are not redeemable for cash or credit, and may not be used in connection with any other offer, promotion or discount unless otherwise provided by us in writing. Points may not be sold, transferred or assigned to any other person or Account. You can check your point balance on the Program Site or the App, or by inquiring at a participating Pita Pit location.

We reserve the right to terminate your Account and/or your participation in our Loyalty Program if we determine, at our sole discretion, that you have violated these Terms and Conditions, or that the use of your account is unauthorized, fraudulent or otherwise unlawful. Upon termination, all points will be void.

Redeeming Points for rewards

Below is the redemption schedule for points are needed for each of reward, which is subject to change at any time without notice:

Fan Level

By participating in the Loyalty Program, you are automatically entered into the Fan Level. At the Fan Level, rewards may include:

• When you use your gift card at a participating Pita Pit store you will earn 3 points for every pre-tax dollar spent.
• By registering an Account, you immediately receive a bonus 280 points.
• If you chose to provide us with your month and day of birth, you will receive 400 points on your birthday.

Fanatic Level

At the Fanatic Level, rewards may include:

• When you use your gift card at a participating Pita Pit store you will earn 4 points for every pre-tax dollar spent.
• If you choose to provide us with your month and day of birth, you will receive 400 points on your birthday.

From time to time, we may (but are under no obligation to) offer special bonus points or rewards. Eligibility for such bonuses will be determined by us in our sole discretion, and may be subject to additional terms and conditions released in association with such an offer. Special bonus points may expire, subject to the terms and conditions applicable to the specific offer.

General Loyalty Program Terms

Any applicable federal, provincial and local taxes connected to the redemption of reward points through the Loyalty Program are the sole responsibility of the member. We will not be responsible for any tax consequences which may flow from participation in the Loyalty Program.

Participants have no ownership interest in points, and points do not constitute property of the participants. Use of the word “earn” herein and in marketing materials in relation to the Loyalty Program shall mean “collect” and shall not infer that the rewards have any value until they are redeemed. Despite our best efforts to ensure accuracy, errors occasionally occur. We reserve the right to correct such errors at any time even if it affects pending points and/or rewards.

Our failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision. The invalidity or unenforceability of any provision of these Terms and Conditions shall not affect the validity or enforceability of any other provision. If any provision of the Terms and Conditions is determined to be invalid or otherwise unenforceable, then the Terms and Conditions shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. We reserve the right to correct any typographical or printing, errors. In no event shall our liability with respect to the Loyalty Program be greater than the value of the Reward claimed at the time the dispute arose. Any proceedings relating to matters regarding the Loyalty Program shall be brought exclusively in the courts of the City of Toronto in the Province of Ontario.
